Advice From Counsel Featured in Security Technology Executive Magazine

As the head of FTI Consulting's Information Governance, Privacy & Security practice, I was recently asked to contribute an article to Security Technology Executive magazine outlining the findings from FTI’s most recent Advice from Counsel (AFC) study. With organizations increasingly challenged to support the modern workplace environment – mobile phones, remote employees, cloud collaboration sites, social media, IM platforms and chatrooms – while keeping this data secure and easily retrievable for legal or regulatory needs, we at FTI conducted the latest iteration of AFC to uncover how legal teams are handling the challenges.

Counsel have become more involved in driving information governance initiatives and providing guidance on how to address data security challenges in the context of strong legal and compliance standards. They are beginning to consider how to create an information governance framework that protects data while staying adaptive to the rapidly evolving business landscape, and many have advice on how legal teams at large organizations can begin to take action. In the study, which I discussed in detail in Security Technology Executive, seven key themes for tackling data security emerged.

Respondents' input provided an insightful glimpse into how today’s most sophisticated in-house teams are navigating anti-fraud, data privacy, regulatory compliance, information governance and other risk management activities. Their recommendations included:

  • Start with a Data Assessment
  • Engage Internal and External Experts
  • Prioritize Data Remediation
  • Prepare for GDPR
  • Use Migration to Microsoft 365 as an Opportunity
  • Right-Size Your Solutions
  • Take a Multi-Faceted Approach
