FTI Consulting and Fulbright & Jaworski to Share FCPA Investigation Best Practices Webcast

Hosted by Main Justice, Event to Share Legal and Technical Considerations for Multinational Matters
Press release

West Palm Beach, Fla., Sept. 30, 2011 FTI Consulting, Inc. (NYSE: FCN), the global business advisory firm dedicated to helping organizations protect and enhance their enterprise value, today announced that the firm's Technology practice will host a complimentary webcast on Oct. 4, presenting e-discovery best practices for investigation matters, including investigations under the U.S. Foreign Corrupt Practices Act (FCPA). The co-presenters, Kelly Garrett Thorman of Fulbright & Jaworski and Craig Earnshaw of FTI Consulting, will discuss how legal and consulting firms can collaborate and apply industry best practices for foreign investigations. Mary Jacoby, Editor of Main Justice, will moderate the discussion, and registration is available here.

“For legal teams conducting international FCPA investigations, maintaining a defensible document collection and review process while adhering to local data privacy requirements require creative solutions,” said Kelly Garrett Thorman, Senior Associate in Fulbright & Jaworski’s Washington, D.C., office. “This webcast is designed to provide practical considerations and to highlight how conducting a review outside the United States can be less burdensome and may even create efficiencies for the legal process.”

With the widely reported growth in FCPA enforcement by the U.S. Department of Justice and the U.S. Securities and Exchange Commission and the enactment of the new U.K. Bribery Act, corporations are increasingly required to conduct anti-bribery due diligence and investigations across the globe. EU and other sovereign data privacy laws can make it a challenge to comply with U.S. regulators’ expectations for credible investigations. Complying with U.S. and EU requirements can necessitate creative solutions and a strategic legal and technical partnership to gather and review the necessary data and documents.

Attendees of this webcast will learn both the legal and technical perspectives on:

  • Data privacy requirements as they relate to investigations.
  • Practical steps and considerations for large-scale international on-site document collection, processing and review.
  • Best practices from recent European investigations.

“Whether handling small, in-house investigations or a large, complex foreign review, the data privacy principles and best practices are the same,” said Craig Earnshaw, a Managing Director in the Technology practice at FTI Consulting in its London office. “Attendees will learn practical guidance on conducting a foreign document collection and review process for FCPA and other types of investigations.”
